Former President Trump Asks High Court Permission for Military Reserve Troop Deployment in Chicago Area
On Friday, the White House submitted an urgent appeal to the federal top court, asking for approval to deploy state guard troops to the state of Illinois.
This action is part of a broader campaign to widen the internal deployment of the troops in a number of urban centers under Democratic control.
Legal Battle Over Troop Deployment
In an urgent petition, the justice department urged the bench to reverse a previous judicial decision that had stopped the stationing of hundreds of state guard members to the greater Chicago.
The district judge had raised doubts about the government's justification for sending troops, questioning its rationale in considering local conditions.
A federal appeals court affirmed the previous order on midweek, leaving the deployment on standby while the judicial dispute continues.
Government's Claims
The top government lawyer, representing the government, claimed in the new filing that government officers have frequently been âthreatened and assaultedâ in downtown Chicago and the neighboring town of Broadview community.
This site is home to an Immigration and Customs Enforcement holding center.
The president has earlier dispatched state guard units to Chicago and Portland, following earlier deployments to LA, Memphis, Tennessee, and Washington, District of Columbia.
The president has stated that military intervention is necessary to control demonstrations and bolster border control.
Partisan Opposition
Opposition leaders have vehemently criticized the action, claiming that the presidentâs claims are inflated and partisan in nature.
They allege the former president of abusing his executive power to retaliate against critics.
Court officials have also expressed doubt about the White House's description of events.
Local leaders say that protests over immigration enforcement have been mostly modest and non-violent, challenging the former president's characterization of âwar zoneâ conditions.
Statutory Grounds
At the heart of the conflict is the presidentâs use of a US code permitting the commander-in-chief to take control of the military reserve only in instances of rebellion or when âunable with the standard military to execute the regulations of the United Statesâ.
The White House insists that the personnel are essential to defend US facilities and personnel from demonstrators.
Latest Events
In recent weeks, the government nationalized three hundred members of the state guard of Illinois and commanded more Texas national guard troops into the state.
As local leaders criticized the action, the former president intensified his language, calling on the apprehension of Chicagoâs mayor and the Illinois governor, the two Democratic officials, accusing them of not managing to safeguard immigration officers.
State authorities and Chicago jointly sued the government to halt the deployment.
On 9 October, district Judge April Perry, appointed by Joe Biden, delivered a temporary injunction preventing the directive.
On-the-Ground Incidents
Meanwhile in Chicago, at least 11 people were detained outside the federal detention center following intense clashes between Illinois state police and demonstrators.
